1. Acceptance of Terms

By downloading, installing, accessing, or using the TradeSignal AI mobile application ("App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Batak Solutions ("Company," "we," "us," or "our").

2. Description of Service

TradeSignal AI is a mobile application that provides AI-generated stock market analysis, trading signals, and educational content. The App uses artificial intelligence algorithms to analyze market data and generate potential trading opportunities.

The Service includes:

• AI-generated trading signals (bullish/bearish indicators)
• Price target suggestions
• Stop-loss recommendations
• Market analysis and commentary
• Educational content about trading

3. IMPORTANT DISCLAIMER: NOT FINANCIAL ADVICE

3.1 No Financial Advice

TradeSignal AI and all content provided through the App are for EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY. Nothing in this App constitutes:

• Financial advice
• Investment advice
• Trading advice
• Tax advice
• Legal advice
• A recommendation to buy, sell, or hold any security
• A solicitation to invest in any financial instrument

3.2 Not Licensed Advisors

Batak Solutions and its employees, contractors, and affiliates are NOT:

• Licensed financial advisors
• Registered investment advisors
• Certified financial planners
• Broker-dealers
• Licensed to provide financial advice in any jurisdiction

3.3 No Guarantees of Performance

While our AI models have shown promising results in backtesting and internal testing, this does NOT guarantee:

• Similar performance for any user
• Profitable trades
• Accuracy of any signal or prediction
• That any specific outcome will occur

Market conditions change constantly. Historical testing cannot account for all market scenarios. Individual results will vary significantly.

3.4 Acknowledgment of Risk

By using this App, you acknowledge and agree that:

• Trading involves substantial risk of loss, including the possible loss of your entire investment
• You may lose more money than you initially invest
• The stock market is inherently unpredictable
• No algorithm, AI, or analysis method can predict market movements with certainty
• You are solely responsible for your own investment decisions
• You should never invest money you cannot afford to lose

Before making any investment decision, you should:

• Consult with a qualified, licensed financial advisor
• Conduct your own research ("DYOR" - Do Your Own Research)
• Consider your personal financial situation, risk tolerance, and investment goals
• Understand the risks involved in trading securities

4. Eligibility

To use the App, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information

By using the App, you represent and warrant that you meet all eligibility requirements.

5. User Accounts

5.1 Account Creation

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized access to your account

5.2 Account Responsibility

You are solely responsible for:

• All activities that occur under your account
• Maintaining the security of your account credentials
• Any consequences resulting from unauthorized access due to your failure to protect your credentials

6. Subscription and Payments

6.1 Subscription Plans

The App offers subscription plans ("Pro" or "Elite" tiers) that provide access to premium features. Subscription details, pricing, and features are displayed within the App.

6.2 Payment Processing

All payments are processed through Apple's App Store. By subscribing, you agree to Apple's terms and conditions for in-app purchases.

6.3 Billing

• Subscriptions are billed in advance on a recurring basis (monthly or annually)
• Your subscription will automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions through your Apple ID account settings

6.4 Refunds

All refund requests must be submitted through Apple. Batak Solutions does not directly process refunds. Apple's refund policies apply to all purchases made through the App Store.

6.5 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect current subscription periods but will apply to renewals.

7. Limitation of Liability

7.1 No Liability for Trading Losses

7.2 Service Provided "As Is"

THE APP AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of any information
• Uninterrupted or error-free operation

7.3 Maximum Liability

In no event shall our total liability to you exceed the amount you paid to us in subscription fees during the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless Batak Solutions, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the App
• Your trading activities
• Your violation of these Terms
• Your violation of any third-party rights
• Any claim that your use of the App caused damage to a third party

9. Intellectual Property

9.1 Ownership

All content, features, and functionality of the App, including but not limited to:

• AI algorithms and models
• Software code
• Text, graphics, logos, and images
• User interface design
• Data compilations

are owned by Batak Solutions and are protected by international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to access the App (bots, scrapers, etc.)
• Resell, sublicense, or commercially exploit the App
• Remove any copyright or proprietary notices

10. Termination

10.1 Termination by You

You may stop using the App and cancel your subscription at any time through your Apple ID account settings.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Conduct that harms other users or the Company

10.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• We may delete your account and data
• Sections of these Terms that by their nature should survive will survive (including but not limited to: Disclaimers, Limitation of Liability, Indemnification)

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Sending a notification through the App
• Updating the "Last Updated" date

Your continued use of the App after changes are posted constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

12.2 Dispute Resolution

Any dispute arising from or relating to these Terms or the App shall be resolved through:

1. Informal Negotiation: You agree to first attempt to resolve any dispute informally by contacting us.
2. Swedish Courts: If informal resolution fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Sweden.

12.3 Waiver of Class Action

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

13. General Provisions

13.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Batak Solutions regarding the App.

13.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
